Last updated 5 September 2026. These are the terms between My Customer List Pty Ltd and any business that creates an account.
my customer list lets you create an offer, print a card with a QR code, collect the details of customers who scan it, and email those customers. We provide the software; the offer and everything it promises is yours to honour.
You are the owner of the customer details collected through your cards. We store and send on your behalf. You agree that you will only send marketing to customers who ticked the opt-in box, that every email will carry a working unsubscribe, and that you will not upload, import or add contacts from anywhere else. The Spam Act 2003 applies to you as the sender; if you break it we may suspend sending to protect every other business on the platform.
The Free plan costs nothing and never asks for a card. Paid plans are billed in advance in Australian dollars, GST included, through Stripe, monthly or yearly as you choose. You can change or cancel your plan from your account at any time; a cancelled paid plan runs to the end of the period you have paid for and then returns to Free. If you go over a plan’s customer limit, your card keeps working and your list stays yours to download; new sign-ups pause until you upgrade. We will not raise the price of a plan you are on without emailing you at least 30 days beforehand.
Use the service to collect details from anyone under 16; make offers you do not intend to honour; send anything unlawful, misleading or abusive; or try to break, overload or reverse-engineer the service.
We work to keep the service available and your data safe, and we will tell you promptly if there is a security incident affecting you. We do not promise the service will be uninterrupted or error-free. To the extent the Australian Consumer Law allows, our liability to you is limited to the fees you paid us in the three months before the claim, and we are not liable for indirect loss such as lost profits. Nothing here excludes rights you have under the Australian Consumer Law that cannot be excluded.
You can delete your account at any time and take your list with you first. We may suspend or close an account that breaks these terms, after telling you why unless the law prevents us. Either way, we delete your customer data within 30 days of the account closing, except records we must keep by law.
These terms are governed by the laws of Victoria, Australia. If we change them materially we email you 30 days before the change applies. Questions: hello@mycustomerlist.com.
